Premises Liability law is the body of law which makes landowners responsible for certain injuries suffered by people who venture onto the premises. Although these "slip and fall" cases can seem simple, in many states the law has made these cases more difficult to prove. Therefore, it is always best, when pursuing such a case, to consult a lawyer. These types of claims occur often, and business owners and their insurance companies have grown very capable of defending themselves against people who were injured on company or business property.

Invitees

Anyone who is invited to enter or remain on commercial premises is referred to as an "invitee".  For example, a shopper at the local grocery store is considered to have been invited to shop at the store; therefore, the shopper is the "invitee".  Business owners have an express duty and obligation to ensure that invitees are free of dangers to themselves and their property.  Further, business owners have a duty to use care to warn and protect invitees from if:

  • the risk of harm is unreasonable, and
  • the business owner knows or in the exercise f ordinary care should know of the condition, and should realize that it involves an unreasonable risk of harm to an invitee.

The business owner typically has a duty to inspect the premises hazards to those who are invited to the premises.  For example, a grocery store should periodically check its floors for the presence of spilled or broken merchandise, and to make sure that its products are not likely to fall from its shelves.

Other premises liability claims may exist for against homeowners, if through the homeowner's negligence, someone is injured.  In such cases, the homeowner should have known that the dangerous condition would lead to an injury or damage.
